Your use of the website at www.awakened-leadership.com ('the Site') is governed by these terms of use ('Terms'), and by using this Site you confirm that you have read and agreed to these Terms. You may print and keep a copy of these Terms, which are a legal agreement between you and us and can only be modified with the prior written consent of High Impact Leadership Institute. High Impact Leadership Institute reserves the right to change the Terms at its discretion by changing them on this web page of the Site, and it is your responsibility to check the Terms regularly to take notice of any changes made by us, as they are binding on you. Awakened Leadership Program is a brand name of High Impact Leadership Institute. If you do not agree with any of the terms and conditions in these Terms you must cease use of the Site immediately.

1. Accuracy of Information and Disclaimer

1.1 High Impact Leadership Institute aims to ensure that all information on the Site is accurate. However, the Site and material available on the Site is provided for general information purposes only and is not intended to provide comprehensive information or guidance on the subjects covered. Before entering into any contract based on or relating to information on this site, you should obtain full information from the organisation or individual with whom you are establishing the contract. High Impact Leadership Institute is not responsible for information provided by any third party in relation to such a contract.

1.2 You acknowledge that any reliance on any information or other material contained on this Site is entirely at your own risk and all other warranties, undertakings, conditions and terms, express or implied, whether by common law, statute, custom, trade usage, course of dealings or otherwise (including without limitation as to quality, fitness for purpose, performance or suitability for purpose) in respect of the Site are hereby excluded to the fullest extent permitted by law.

1.3 You acknowledge that we cannot guarantee that the Site will always be available to you, owing to the nature of the internet. In addition, you acknowledge that the Site may be unavailable owing to maintenance, but where possible we will carry out such maintenance outside core operating hours, and we will try to minimise the period of any disruption.

2. Code of conduct

2.1 You agree to ensure that any details which you supply to us through the Site are accurate and to let us know promptly if any of the details which you have supplied to us about you change.

2.2 If accessing any part of the Site that requires you to enter a password you agree to keep any personal login name and password for use on the Site confidential, and to be responsible for any loss or damage resulting from use of your password by any third party.

2.3 We reserve the right to terminate your access to password protected areas of the Site should we consider that your use of the Site is detrimental to the Site or to other users.

2.4 If accessing any part of the Site you agree:

2.4.1 not to use the Site in such a way that disrupts, interferes with or restricts the use of the Site by other third party users;

2.4.2 to ensure that any materials uploaded, displayed or transmitted by you through or to the Site are not false, offensive, defamatory, threatening, obscene, unlawful and do not breach or infringe the rights of any person anywhere in the world and you waive any moral rights in respect of any such materials;

2.4.3 not to reverse engineer, decompile, copy or adapt any software or other code or scripts forming part of the Site nor attempt to transmit to or via the Site any information that contains a virus, worm, Trojan horse, or other harmful or disruptive component;

2.4.4 not to send 'spam' email or any unsolicited correspondence which is unrelated to the business of High Impact Leadership Institute, to any addresses made available on the Site; and

2.4.5 not to change, modify, delete, interfere with or misuse data contained on the Site entered by or relating to any third party user of the Site.

2.5 If we suffer loss owing to a breach by you of these Terms of use, you agree to indemnify us fully for any such loss.

2.6 You should satisfy yourself that you have appropriate protection against computer viruses, worms, Trojan horses or other items of a destructive nature whilst using the internet, and that your connection to the Site is secure.

2.7 The Site may include hypertext links to third party web sites. High Impact Leadership Institute Accepts no responsibility for and can give no warranties, guarantees or representations in respect of, the content or availability of material of any third party site.

2.8 Any opinions expressed on any part of the site are not necessarily hose of High Impact Leadership Institute, or anyone connected with High Impact Leadership Institute. We reserve the right to edit or delete any postings at our sole discretion.

2.9 You shall not create any hypertext link to the Site or any part of it from outside of the Site or otherwise without prior written permission from High Impact Leadership Institute.

3. Our program contract & policy

3.1 When registering you are entering into a binding contract and financial obligation with High Impact Leadership Institute. 

3.2 After you've completed the registration you will receive an invoice for the total amount. The 10% registration fee is due within 14 days. This is also the reflection time we are requiered to extend under the Dutch Consumer Law. The remaining balance needs to be settled no later than 90 days before the start date of the Phase.

3.3 Depending on the Phase you want to register in we requirer some level of self awareness. This will be reviewd by The Institute based on your application. We withhold the right to disallow your application and is such is the case, contact you personally to discuss the options.

3.4 For all three levels your stay with us is full board. This means that the course, your luxury room, breakfast, lunch and dinner are included. Our airport shuttle will drive you from and to San Jose International Airport. Your stay will start on Saturday and will end on Saturday. Both of these days are also included. Please be aware that some things you need to take care of yourself. This includes: your personal flights, your hotel room if you're arriving the day before, alcoholic beverages, cel phone costs, personal travel insurance, massages and gifts.

3.5 To avoid the need for cancellation please ensure you are clear about your dates and costs before you book. All registrations fees are non-refundable. If however you do need to cancel more then 90 days before the start dat of your Phase we have a couple of options:

  • You can join at the next available date and pay 10% registration fee.
  • You can or let some else take your place and pay 10% registration fee.
  • The total amount minus the registration fee will be refunded.

When the Phase is less then 90 days from starting non of the above is applicable and there will be no refund possibible.

3.5.1 Cancellation of our part may occur if we feel the group size is insufficient to give you the maximum experience and quality you deserve. If such may occur you wil be notified no later than 90 days before the start of the Phase and will be presented with the following options:

  • You can join at the next available date at no additional cost.
  • The total amount including the registration fee will be refunded.

 

3.5.2 Force Majeur: If for any reason beyond the Institutes, the venue or the individual guest's reasonable control, including but not limited to civil disorder; disasters; acts of war; acts of God; fires; flood or other emergency conditions; any delay in necessary and essential repairs of the venue; the institute, the venue or the individual guest is unable to perform its obligations under this Agreement, such non-performance is excused and such party may terminate this agreement without further liability of any nature, upon return of "Client's" deposit. In no event shall the Institute, the venue or individual guest be liable for consequential damages of any nature for any reason whatsoever

3.6 During the course of your Phases High Impact Leadership may take photo's and or film recordings. These can be used for promotional purposes. By registering with us you accept that your image(s) can appear in one of our campagnes, website or Social Media outlets. If you have a pressing reason why your image(s) may not be used, please let us know so we can take appropriate action.

3.7 It is very important to us that you are satisfied with our services. In the unlikely event that the service does not meet your expectations, you can file a formal complaint within 4 weeks after the event has taken place. Within 14 days you will be contacted by the director of the Institute in order to agree on a suitable solution within 6 weeks. Your complaint will be treated confidentially. Please send your complaint by e-mail, provided with substantiation, to info@awakened-leadership.com

3.7.1 Are you dissatisfied with the way we have handled your complaint? Please contact our independent complaints committee within 2 weeks of receiving our substantive response. You can reach them by sending an e-mail to the chairman of the complaints committee mr. A.Daleman, Financial Planner (FFP) anton@daleman-dejong.nl. The decision of the Board is in the form of a binding recommendation within 4 weeks.

3.7.2 All received complaints will be registered by the Institute and the files will be saved for 1 year.

4. Copyright and intellectual property

4.1 The copyright and other intellectual property in material contained in the Site and distributed and/or made during training, including without limitation in text, images, scripts and sounds, is owned by High Impact Leadership Institute except where otherwise stated. © High Impact Leadership Institute 2018.

4.2 You may print extracts from the Site or any of its pages for your personal use or to assist in preparing for a upcoming course or event provided by High Impact Leadership Institute,
but not for any other purpose.

4.3 You may make a temporary copy of these pages for the purposes of viewing the pages with browser software, but must not otherwise copy, reproduce or re-distribute the contents of these pages in whole or in part without the prior written consent of High Impact Leadership Institute

4.4 All other rights are reserved.

4.5 Awakened Leadership Program is a brand of High Impact Leadership Institute and as such legally protected in the Netherlands and in other countries.

5. Data protection

5.1 By using this site, including registering to acces secure areas on the site, you consent to High Impact Leadership Institute processing any personal data you give to us, including any data classified by the data protection act 1998 as ; sensitive personal data', in accordance with our data protection and privacy statement.

6. Other agreements

6.1 These Terms shall not affect or override any the terms of any other written agreement which you have with High Impact Leadership Institute.

8. Governing law and jurisdiction

8.1 These Terms shall be governed by and construed in accordance with Dutch law. Each party irrevocably agrees to submit to the non-exclusive jurisdiction of the courts of the Netherlands over any claim or matter arising under or in connection with these Terms and conditions.

8.2 The language of these Terms is English, if they are translated into any other language, the English language text shall prevail.
